Terms of Service

1. Acceptance of terms

By creating an account or otherwise accessing Musiome ("the Service", "we", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service. These terms constitute a legally binding agreement between you and Musiome.

2. Account responsibilities

You are responsible for maintaining the security of your account credentials. Specifically, you agree to:

• Provide accurate and up-to-date information during registration.
• Keep your password confidential and notify us immediately of any unauthorized access.
• Accept responsibility for all activity that occurs under your account.
• Not share your account with other individuals.

3. Acceptable use

You may use the Service only for lawful purposes. The following are strictly prohibited:

• Uploading content that infringes third-party copyright, trademark, or other intellectual property rights.
• Distributing illegal content, including content that promotes illegal activity.
• Publishing hate speech, content that incites violence, or content that discriminates on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Impersonating another person or entity.
• Attempting to gain unauthorized access to the Service or its underlying infrastructure.
• Using the Service to send unsolicited commercial communications (spam).

4. Intellectual property

You own your content. By uploading content to Musiome, you retain all ownership rights. However, you grant Musiome a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and improving the Service (for example, rendering your public profile or processing audio files for streaming).

This license terminates when you remove the content from the Service or delete your account, subject to reasonable technical propagation delays and any applicable legal retention obligations.

5. Payment terms

Subscription payments on Musiome are processed by Polar. By initiating a subscription, you agree to Polar's payment terms and refund policy.

• Subscriptions are billed on a recurring basis at the interval selected at checkout.
• Refund eligibility is determined by Polar's refund policy.
• Musiome does not store or process payment card data.
• Prices are displayed inclusive of any applicable taxes where required by law.

6. Limitation of liability

To the maximum extent permitted by applicable law, Musiome and its operators shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, goodwill, or other intangible losses.
• Damages resulting from unauthorized access to or use of our servers or any personal information stored therein.
• Damages resulting from interruption or cessation of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

7. Termination

Either party may terminate the agreement at any time.

• You may delete your account at any time from your account settings. Upon deletion, your public profile and content will be removed.
• We reserve the right to suspend or permanently ban accounts that violate these Terms, with or without prior notice.
• We may also terminate the Service entirely at our discretion, in which case we will provide reasonable advance notice where possible.

8. Governing law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

9. Changes to terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Where changes are material, we will make reasonable efforts to notify registered users (for example, via email or an in-app notice). Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
